By downloading, accessing, or using IMPULSE404 ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

IMPULSE404 is a disruption tool designed to interrupt unhelpful thought patterns and behavioural loops through character-based audio prompts and interactive interventions.

IMPORTANT: IMPULSE404 is NOT:

• A mental health app, therapy app, or wellness app

• A medical device or medical treatment

• A therapeutic service or counselling tool

• A weight loss or fitness app

• A substitute for professional medical, psychological, or psychiatric care

 

The App is designed for personal use as an interruption and pattern-breaking tool only. It does not diagnose, treat, cure, or prevent any medical or mental health condition.

3. Medical Disclaimer

CRITICAL: This App is a disruption and interruption tool, NOT a medical, mental health, therapeutic, or wellness service.

• The App does not provide medical advice, diagnosis, treatment, or therapy

• The App is not intended to replace, supplement, or assist with professional medical or mental health care

• The App does not diagnose, treat, cure, or prevent any disease, medical condition, or mental health condition

• Always seek the advice of qualified health professionals for any questions regarding medical or psychological conditions

• Never disregard professional medical advice or delay seeking it because of anything experienced through the App

• If you are experiencing a mental health crisis or emergency, contact emergency services immediately (999 in the UK, 911 in the US, or your local emergency number)

 

The App is solely for personal interruption and pattern-breaking purposes and makes no claims regarding health, wellness, or therapeutic outcomes.

4. Subscription Terms

​

4.1 Premium Subscription

• Monthly subscription at the price displayed in the App Store

• Payment charged to your Apple ID account at confirmation of purchase

• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• No refunds for the current subscription period

 

4.2 Managing Your Subscription

• Manage and cancel subscriptions in your App Store account settings

• Cancellation takes effect at the end of the current billing period

• Access to premium features continues until the end of the paid period

 

4.3 Free Trial (if applicable)

• Free trial periods, if offered, will be forfeited upon purchase of a subscription

 

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose

• Attempt to reverse engineer, decompile, or hack the App

• Use the App in any way that could damage, disable, or impair the service

• Share your account credentials with others

• Use automated systems to access the App

 

6. Intellectual Property

 

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by IMPULSE404 and protected by copyright, trademark, and other intellectual property laws.

6.1 Third-Party Content

Character Artwork: Certain character artwork and visual elements used in the App are sourced from Canva and modified for the App's purposes. These elements are used under Canva's licensing terms. We do not claim ownership of the original third-party design elements.

Audio Content: Character voices and audio interventions are generated using ElevenLabs AI voice synthesis technology, used under their licensing terms. The audio content is created specifically for this App.

All third-party content may be replaced or updated in future versions of the App.

6.2 User Rights

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

7. User-Generated Content

​

If the App allows you to create or submit content:

• You retain ownership of your content

• You grant us a license to use, store, and process your content solely to provide the service

• We do not access or share your personal content with third parties

 

8. Data Privacy

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "as is" without warranties of any kind

• We are not liable for any indirect, incidental, special, or consequential damages

• We are not responsible for any harm resulting from your use or inability to use the App

• Our total liability shall not exceed the amount you paid for the subscription in the past 12 months

 

10. Indemnification

You agree to indemnify and hold harmless IMPULSE404, its developers, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

 

11. Termination

​

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion.

12. Changes to Terms

​

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of material changes through the App or via email.

13. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

• These Terms are between you and IMPULSE404, not Apple

• Apple has no obligation to provide support for the App

• Apple is not responsible for any claims relating to the App

• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country

• You comply with all third-party terms when using the App

 

By using IMPULSE404, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
